Terms and conditions of sale

Article 1 – Purpose

These conditions govern the sales of online programs and consultations by Sandrine Chastaignet.

Article 2 – Prices

The prices of our online programs are indicated in euros excluding tax (VAT not applicable, article 293B of the CGI). In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of Sandrine Chastaignet.

They will be at your expense and are your sole responsibility in terms of declarations and payments to the authorities and competent bodies of your country. We advise you to inquire about these aspects with your local authorities. All orders, regardless of their origin, are payable in euros (€).

Sandrine Chastaignet reserves the right to change its prices at any time, but the product will be invoiced based on the rate in effect at the time of order validation and subject to availability.

The digital programs and products remain the property of Sandrine Chastaignet until full payment of the price. The purchase of an online program does not transfer the copyright of the creation to the buyer. All creations presented on this site are the property of Sandrine Chastaignet. For more details on intellectual property, please read the relevant paragraph ‘Intellectual Property’.

Article 3 – Orders

You can place an order via the “Online Programs” page of the Sandrine Chastaignet website and via the “coaching” page for individual sessions. Contractual information is presented in French and will be confirmed at the latest when your order is validated. Sandrine Chastaignet reserves the right not to record a payment and not to confirm an order for any reason whatsoever, and more particularly in the event of a technical problem or difficulty regarding the order received.

Article 4 – Validation of your order

Any order placed on the website implies full acceptance of these General Conditions of Sale. Any confirmation of an order implies your full and complete acceptance of these general conditions of sale, without exception or reservation. All the data provided and the confirmation recorded will constitute proof of the transaction. You declare to have perfect knowledge of it. The confirmation of the order will be considered as a signature and acceptance of the operations carried out.

Article 5 – Payment

Validating your order implies for you the obligation to pay the indicated price.

Payment for your purchases is made:

• By credit card

Access to the ordered online program/session will be sent to you within 48 hours after receipt of payment.

Article 6 – Right of Withdrawal

Online Programs

In accordance with the provisions of article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to justify reasons or pay penalties.

In the event of exercise of the right of withdrawal, Sandrine Chastaignet will refund the sums paid, within 14 days following notification of your request and via the same means of payment used during the order.

Online appointment

Free cancellation up to 48 hours before the appointment. The client has the possibility to cancel through their access to the Tydical online agenda, or to send a cancellation email to sandrine@sandrinechastaignet.com. Beyond this limit, the amount of the service will be due and any previously paid sum cannot be refunded.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with the provisions of article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:

• The provision of services fully performed before the end of the withdrawal period and whose execution has begun after the express prior agreement of the consumer and express waiver of his right of withdrawal.
• The supply of goods made to the consumer’s specifications or clearly personalized.
• The supply of goods which, after being delivered and by their nature, are inseparably mixed with other articles;
• The supply of digital content not provided on a material medium whose execution has begun after the express prior agreement of the consumer and express waiver of his right of withdrawal.

Article 7 – Availability

Our products are offered as long as they are visible on the “Online Program” page of the site and within the limits of available places.

Article 8 – Delivery

Access to the programs is delivered to the email address provided during the order process, within 48 hours after receipt of payment. In accordance with legal provisions, in the event of late delivery, you have the option to cancel the order under the conditions and modalities defined in article L 138-2 of the Consumer Code.

Article 10 – Liability

Sandrine Chastaignet cannot be held responsible for damage resulting from improper use of the purchased product.

Finally, Sandrine Chastaignet’s liability cannot be engaged for all inconveniences or damages inherent in the use of the Internet network, including a service interruption, an external intrusion or the presence of computer viruses.

Article 11 – Applicable Law in Case of Disputes

The language of this contract is French. These terms and conditions of sale are subject to French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.

Article 12 – Intellectual Property

All elements of the website are and remain the intellectual property and exclusive property of Sandrine Chastaignet. No one is authorized to reproduce, exploit, rebroadcast, or use in any capacity whatsoever, even partially, elements of the site, whether they are software, visual or sound.

You can place a link to www.sandrinechastaignet.com on your website, blog, or social network, and can also quote passages from said site in accordance with article L.122-4 of the Intellectual Property Code by respecting the following condition: article L.122-5 paragraph 3: The source must be mentioned with a link to the site www.sandrinechastaignet.com

Article 13 – Personal Data

Sandrine Chastaignet reserves the right to collect personal information and data about you. They are necessary for the management of your order, as well as for improving the services and information we send you.

They may also be transmitted to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing, and payment.

This information and data are also kept for security purposes, to comply with legal and regulatory obligations.

In accordance with the law of January 6, 1978, you have the right to access, rectify, and oppose nominative information and personal data concerning you, directly on the Internet site.

Article 14 – Archiving Proof

Sandrine Chastaignet will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code. The computerized records of Sandrine Chastaignet will be considered by all parties concerned as proof of communications, orders, payments, and transactions between the parties.
